DMCA Policy

xFuga is an online service that indexes and displays material submitted by its users. No files are stored on our servers — media is delivered from separate third-party infrastructure. We do not create, select, edit or endorse what users submit. We respond to properly made copyright complaints under the Digital Millennium Copyright Act, 17 U.S.C. § 512, and we remove or disable access to material that is the subject of a valid notice.

Complaints sent to any other address may take longer to reach the right person.

What a valid notice must include

To be effective under § 512(c)(3), your notice must include all of the following:

1. A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material claimed to be infringing, with enough detail for us to locate it — a direct URL on xfuga.com is best.
4. Your contact details: address, telephone number and email address.
5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner's behalf.

A notice missing any of these elements may not be actionable, and we may ask you to supply what is missing.

What happens next

On receipt of a valid notice we remove or disable access to the identified material, ordinarily without delay. Where we can identify the user who submitted it, we notify them and pass on a copy of the notice.

Because files are not stored on our servers, removal takes the form of disabling access through this service. If the underlying file remains available elsewhere, the notice should also be sent to whoever stores it.

Counter-notification

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to dmca@xfuga.com. It must include your signature, identification of the removed material and its former location, a statement under penalty of perjury that you have a good-faith belief the removal resulted from a mistake or misidentification, your contact details, and your consent to the jurisdiction of the federal district court for the district in which you are located — or, if you are outside the United States, any judicial district in which this service may be found.

If we receive a valid counter-notice we may restore the material in 10 to 14 business days, unless the original complainant notifies us that they have filed an action seeking a court order.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. Uploading is restricted to registered accounts so that this policy can be enforced.

Misrepresentation

Under § 512(f), a person who knowingly and materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and legal fees.
